The difference between mental illness and insanity is mental illness is usually a comprehensive and a more inclusive than the term Insanity. Insanity is usually kept for describing severe conditions including psychotic episode to run away from reality. Mental Illness is capable of including both severe and mild forms of mental problems like anxiety or depressions (Comer, 2011).

The McNaughton rules cannot be used to defend a person who drinks alcohol excessively and kills someone. Everyone know that drinking alcohol impair one's judgment and drinking might cause complications with their actions.
