Facts

Petitioner Jagraj Singh is a 36 year old native and citizen of India. Singh left a wife and three children behind when he left India on October 30, 1991; Singh was a Sikh farmer in the Punjab state. Singh supported the Akali Dal movement, a political party which promotes religious and economic freedom for Sikhs.

While Singh was in India he was confronted by armed Sikh separatists who demanded food and the use of his jeep. This resulted in the police coming to his house, handcuffing him, and hitting him with a rifle, while asking questions about the militants.
