The famous case of Brown v Board of Education is best known for starting the segregation in the school system with the Supreme Court making it clear that discrimination of any kind was not allowed or tolerated when it comes to the education of children. Although not a special education case, this case has been referenced to in many special education cases when the question of the student right being violated was in question. Three different but similar court cases appear to expose how these school districts used some guidelines and rules in testing students, who may need special education services, as a way to discriminate against and segregate minority students, all under the guise of following what the assessment said.
